Terms of Service

These Terms of Service (hereinafter referred to as the "Terms") define the rules for using the services provided by Stash Tech solutions Limited, incorporated under the laws of the Republic of Seychelles, having its registered address at House of Francis, Room 303, ile Du Port, Mahe, Seychelles (hereinafter referred to as the "Company", "we", "us" or "our"), a legal entity providing IT services, including but not limited to, software development and modification, backup services, and IT consulting

1. DISCLAIMERS

You expressly understand and agree that our services are provided "as is" and "as available" without warranties of any kind either express or implied.

The Company makes no express warranties and disclaims all implied warranties regarding the services, software, or any applications, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, correctness, accuracy, and reliability.

The Company reserves the right, without providing notice, to temporarily suspend services in order to carry out maintenance work, updates, or modifications.

Without limiting the generality of the foregoing, we do not represent or warrant to you that:

- Your use of our services will meet your specific requirements;

- Your use of our services will be uninterrupted, timely, secure, or free from error;

- Any data provided through our services will be accurate;

- The software or services are free of viruses or other harmful components.

2. USE OF SERVICES

Use of our services constitutes acceptance and confirmation of your consent to be bound by these Terms, all applicable laws, and regulations, and you agree that you are responsible for compliance with applicable laws.

By accepting these Terms and using our services, you represent and warrant that:

- You have full capacity to contract under applicable law;

- You have not previously been suspended or removed from using our services;

- You are not furthering, performing, undertaking, engaging in, aiding or abetting any unlawful activity through your relationship with us;

- You are comporting with and obeying these Terms and all applicable laws;

- You shall not reverse engineer, decompile or otherwise disassemble our software or services;

- You shall not use our services in a way that takes unfair advantage of trial periods or promotional offers;

- You agree to receive electronically all communications, agreements, documents, notices, and disclosures that we provide.

The Company reserves the right at any time in its sole discretion to suspend or terminate services to users who violate these Terms.

When using our services, you agree that you will not:

- Damage, disable, overburden, or impair the functioning of our services in any manner;

- Use any automated means or interface not provided by us to access our services or extract data;

- Distribute viruses, worms, defects, Trojan horses, corrupted files, hoaxes, or any other items of a destructive or deceptive nature.

3. LIMITATION OF LIABILITY

You assume all responsibility and risk with respect to your use of our services. Our services are provided "as is" without warranties, representations, or conditions of any kind, either express or implied.
You understand and agree that we shall not be liable for any indirect, incidental, special consequential or exemplary damages which may be incurred by you, including but not limited to:

- Loss of profits (whether incurred directly or indirectly);

- Loss of goodwill or business reputation;

- Loss of data;

- Cost of procurement of substitute goods or services;

- Any other intangible loss.

4. INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights in the services, including but not limited to software, documentation, and modifications, remain the exclusive property of the Company. Using our services does not give you ownership of any intellectual property rights in our services or the content you access.

5. INDEMNIFICATION

You agree to hold harmless and indemnify the Company from and against any third-party claim arising from or in any way related to:

- Your breach of the Terms;

- Your violation of applicable laws, rules, or regulations in connection with our services.

In such cases, we will:

- Provide you with written notice of such claim, suit, or action;

- Give you the opportunity to control the defense and/or settlement of such claim;

- Provide reasonable assistance in such defense or settlement, upon reasonable request and at your expense.

6. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of the Republic of Seychelles, without regard to its conflict of law provisions.

7. AMENDMENTS

We reserve the right to modify these Terms or any additional terms that apply to our services at any time without prior written notice.
